Rights for people on a treatment order

This information is provided by Victoria Legal Aid, a legal organisation that helps people in Victoria. It was published in June 2016.
This information is for people living in Victoria. Do not rely on this if you live in another place.

What are your rights if you are on a treatment order? This order is used for people with acute mental illness. People who are on a treatment order lose some of their rights and freedoms. They may have to stay in hospital and they can be given treatment, even if they do not agree to it.
This publication contains information about:

  •  what compulsory treatment is
  • how orders are made
  • getting your order revoked
  • getting free legal help.

The publication is available in English and is now translated in the following languages:

  • Arabic
  • Chinese (simplified and traditional)
  • Dari
  • Greek
  • Italian
  • Macedonian
  • Persian
  • Spanish
  • Turkish
  • Vietnamese.

If you have any questions about your rights under mental health laws, you can also contact the Victoria Legal Aid Legal Help phone-line on 1300 792 387.
