Refugee Council’s response to Attorney-General’s draft report to the UN Committee Against Torture

September 2026

RCOA’s submission highlights significant gaps in the Attorney-General’s draft report, including its limited consideration of the rights and treatment of non-citizens in immigration detention, offshore processing and third-country arrangements.

It points to recent legal changes, High Court decisions and UN findings that are not reflected, and raises concerns about protection gaps, transfers to Nauru, risks of harm, ill-treatment and refoulement, family separation, healthcare, the use of restraints and new search powers in Australian detention, and gaps in independent oversight.

RCOA calls for these developments, their implications and associated human rights risks to be properly reflected in the Government’s report, including how Australia’s laws and practices uphold its obligations under the Convention Against Torture.
